OFCCP LAUNCHES ITS NEW CONTRACTOR PORTAL: CONTRACTORS WILL BE REQUIRED TO ANNUALLY CERTIFY DEVELOPMENT/MAINTENANCE OF AFFIRMATIVE ACTION PLANS

December 3, 2021 – On December 2, 2021, the Office of Federal Contract Compliance (“OFCCP”) released a bulletin announcing the creation of its new “Contractor Portal.” That Portal must be used by federal contractors and subcontractors to certify annually that they have developed and are maintaining affirmative action programs for each establishment and/or functional unit as applicable. Contractors may start registering for access to the portal February 1, 2022. The certification feature of the Portal will be available for use on March 31, 2022, allowing Contractors three months to complete the certification process before the June 30, 2022, deadline. The Contractor Portal will also provide a secure portal for submission of Affirmative Action Programs during compliance evaluations. The OFCCP, in explaining the purpose for the Portal’s creation, stated the obvious: the agency had never before had a vehicle for ensuring that all covered federal contractors and subcontractors – not just those who happened to be audited – were fulfilling their AAP obligations, and this Portal will now fill that void
