EEOC Publishes New “Know Your Rights” Poster Which Employers Must Begin Using

November 7, 2023 – On October 20, the EEOC released a “Know Your Rights” poster which updates and replaces the former “EEO is the Law” poster. Although both posters’ versions give an overview of the job discrimination laws the EEOC enforces and the process for filing an EEOC charge, the updated version is designed for readability and contains a QC code that is linked to the EEOC’s website.

The substantive additions include noting that harassment is a prohibited form of discrimination; and explaining that sex discrimination also includes pregnancy and related conditions, sexual orientation and gender identity. The new poster also provides information about equal pay discrimination for federal contractors.

Within a “reasonable amount of time”, covered employers are required by federal law to prominently display the new poster at their worksites in places where notices to applicants and employees are customarily posted such as break rooms or locker rooms. A specific deadline for contractors to update their posters has not been set.
