Representing employers nationally in all the principal areas of labor and employment law, Mark Klyza applies deep insights gained over four decades of practice to help clients stay out of trouble and overcome challenges as they arise. Mark serves a wide spectrum of businesses and industries, including banking, construction, health care, inland waterways and truck transportation, manufacturing, public utilities, retailing, warehousing, distribution, and temporary staffing services. Through building strong relationships, communicating effectively, and drawing on the benefit of his extensive knowledge and keen judgment, he works tirelessly to produce successful results for clients in matters large and small.
With trial and appellate experience in both bench and jury cases and in proceedings before administrative agencies, Mark handles cases involving claims and concerns arising under Title VII, the Americans with Disabilities Act (ADA), Age Discrimination in Employment Act (ADEA), Family and Medical Leave Act (FMLA), Fair Labor Standards Act (FLSA), Worker Adjustment and Retraining Notification Act (WARN), as well as issues before the Occupational Safety and Health Administration (OSHA). Previously, Mark served as staff attorney with the U.S. Department of Labor in Washington, D.C., where he gained valuable insight into how federal agencies approach matters.
Mark guides clients in federal and state employment claims of sexual harassment, wrongful discharge, breach of employment contracts, and discrimination on the basis of race, sex, age, religion, and disability. In addition, he represents management in matters under the National Labor Relations Act (NLRA), including union organizing, representation elections, union decertification, arbitration, and defense of unfair labor practice charges.
On the preventative side of his practice, Mark regularly provides training and counseling for supervisors, managers, and executives on policies and procedures that help them avoid claims and lawsuits. In working to ensure they stay compliant, he keeps them updated on issues such as applicable employment laws and regulations, human resources administration, employee relations, and effective supervision practices. Mark also drafts comprehensive employment agreements that help prevent pitfalls.
