Eric R. Miller



Mr. Miller, a native of Shreveport, Louisiana, is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization. He has extensive experience in the representation of management in all phases of employee relations, including (1) defending claims of discrimination arising under Title VII of the Civil Rights Act and other various civil rights acts before state and federal administrative agencies and courts; (2) defending employers in wrongful termination, whistleblower and other tort claim suits; (3) handling claims arising under the Fair Labor Standards Act and before state compensation commissions, and providing advice to employers as to compensation plans and exemptions from minimum wage and overtime requirements; (4) conducting audits of employment policies and procedures, and training supervisors and managers on discrimination and harassment issues; (5) representing employers in grievances under collective bargaining agreements, and unfair labor practice charges before the National Labor Relations Board; (6) assisting employers in union avoidance matters, and in defense of breach of contract and breach of the duty of fair representation arising under the LMRA; (7) representing employers in ERISA litigation; (8) assisting employers in drafting and seeking enforcement of employment contracts and non-compete agreements; and (9) providing ongoing advice and counsel regarding employment issues, including the review, development and implementation of company policies and employee handbooks.

Mr. Miller is an active member of the Labor and Employment Law Sections of the Louisiana, Texas, and Houston Bar Associations. He serves on the Baton Rouge Bar Association Pro Bono Committee, Law Expo Committee and CLE Committee. He serves on the Louisiana State Bar Association’s Access to Justice Committee. He is also a contributing author to the BNA Wage and Hour Laws: A State By State Survey for Louisiana. He is a member of the Wex Malone Chapter of the American Inns of Court, the Republican National Lawyers Association, the Federal Bar Association (Baton Rouge Chapter), and the Society for Human Resource Management. Mr. Miller also sits on the Capital Area Legal Services Corporation Board of Directors.
