Practice Overview

In a practice spanning the nation, Malerie Bulot handles employee benefits, executive compensation, and employment tax issues for clients in industries including healthcare, oil and gas, government contracting, nonprofit and advertising. Bringing a calm, personable approach, she gets to know her clients and their concerns and goals in depth so she can tailor strategies and responses that best fit their business needs.

Malerie places a particular focus on guiding employers in the implementation, changes, and termination of benefits including 401(k), 403(b), and health and welfare plans, as well as the resolution of payroll tax issues and audits. She astutely helps businesses navigate their difficult fiduciary and other legal obligations and ensures they receive the guidance needed to comply with the Employee Retirement Income Security Act of 1974 (ERISA), Internal Revenue Code, and rules and regulations promulgated by government agencies like the Department of Labor (DOL), Pension Benefit Guaranty Corporation (PBGC), and the Internal Revenue Service (IRS). In addition, Malerie advocates for clients in the context of mergers and acquisitions regarding employee benefits and executive compensation, and ERISA litigation stemming from disputes about benefits owed under plans and breach of fiduciary duty claims.

Always looking to add value for her clients, Malerie stays current on regulatory changes and other developments that could affect clients’ businesses and legal strategies. When they come to her with questions or problems, she responds not only to the issue at hand but also proactively calls attention to other potentially problematic issues that should be addressed.

Malerie particularly enjoys unraveling multifaceted compliance issues that require her to dig deep into regulatory guidance and to pull out relevant facts and information. When tackling an intense or obscure research project, she finds it highly gratifying to forge a creative pathway towards the optimal answer or resolution.

Malerie’s legal background enriches her current practice. Previously, she worked in the employee benefits and executive compensation group of Proskauer, an international AmLaw 50 firm. During law school, Malerie served as a judicial extern for the Honorable Shelly D. Dick and as a senior editor of the Louisiana Law Review.
