Eric Miller is a labor and employment litigator who draws on extensive experience in representing management-side clients in all phases of worker relations. Eric handles a broad spectrum of matters in state and federal courts and before governmental agencies, including OSHA, the NLRB and DOL. A seasoned trial lawyer with outstanding oral advocacy skills, he defends claims under statutes such as Title VII of the Civil Rights Act, ADA, ADEA and other federal and state employment laws. He also advocates for clients in wrongful termination, whistleblower, deceptive trade practice claims, restrictive covenants, and other tort claim suits. Eric is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization.
On the labor side, Eric advises clients in disputes arising under the FLSA and before state commissions, providing counsel on compensation plans and exemptions from minimum wage and overtime requirements, as well as other issues. He represents employers in grievances under collective bargaining agreements and in unfair labor practice charges before the NLRB. In addition, Eric assists clients with union avoidance and defends management in breach of contract and breach of the duty of fair representation cases arising under the LMRA.
Taking all measures to help clients avoid potentially litigious situations and other legal dangers, Eric provides ongoing advice on a range of employment issues. These include the review, development, and implementation of company policies and employee handbooks, drafting employment contracts and non-compete agreements, and seeking enforcement of those documents. Additionally, he keeps employers updated on new developments to ensure they remain compliant with all relevant laws and regulations. Eric also conducts audits of employment policies and procedures and trains supervisors and managers on preventing discrimination and harassment.
